Training Costs Recovery Agreement

If you want to pay for training for employees but are concerned about the costs if they leave your employment shortly after, then this agreement will assist you and provide some peace of mind.

This template Training Costs Agreement covers the key points needed to ensure that you have a legally binding agreement in place and that both you and the employee understand when the employee may be liable to repay you for some or all of the training costs.

Description

As an employer you may be keen to provide skills and training for your employees, but the costs of this training can be expensive and therefore understandably you will want to receive some payback or benefit from the training.

Normally this payback or benefit from your investment comes from the skills that the employee brings to your business over a period of time, however what happens when an employee leaves their employment with you shortly after they have completed the training?

If they are going to work for a competitor, they will be taking the skills they have learned on the training you have paid for, to their new employer. Even if they are not going to work for a competitor their new employer will get the benefit of the training that you have paid for.

It is for this reason that we would encourage you to put in place a Training Costs Agreement with the employee before you pay for the training.

You can include similar or the same terms as set out on the Training Costs Agreement in the employment contract, and this is advisable to do, however if you are paying for a particular course or something that carries a higher than normal cost, then it is advisable to issue a Training Costs Agreement to the employee before you pay for the course as well.

The reason for doing so is that it makes the employee very clear about their potential liability and the cost of that liability if they go on with the training and then leave within a short period of time thereafter.
